Section 504

Section 504 is a federal law that protects the rights of individuals with disabilities in programs that receive federal funding, like our public schools. Its core purpose is to eliminate barriers and provide equal access to education.

The law requires school districts to provide a Free Appropriate Public Education (FAPE) to all qualified students. This means providing accommodations and services so a student with a disability can participate fully and benefit from their education.

A student may be eligible for a 504 Plan if they meet all three of the following criteria:

• Has a Disability: They have a physical or mental impairment.

• Substantially Limits: This impairment substantially limits one or more major life activities (such as learning, reading, concentrating, walking, seeing, hearing, or speaking).

• Needs Accommodations: They require accommodations to access their education equally.

Please note: Eligibility is not automatic. It is a team decision made based on information from a variety of sources.

1. Referral: A parent, teacher, or staff member can refer a student for a 504 evaluation if they suspect a disability is impacting their learning.

2. Evaluation: The school collects and reviews information about the student. This can include medical records, teacher observations, report cards, and standardized test scores.

3. Team Meeting: A team of people who know the student—including parents, teachers, and the 504 coordinator—meets to review the information and decide if the student is eligible.

4. 504 Plan Development: If the student is eligible, the team works together to create a written 504 Plan. This document outlines the specific accommodations and supports the student will receive.

5. Implementation & Review: The plan is put into action by school staff. The team meets at least once a year to review the plan and make sure it is still meeting the students' needs.

It's common to confuse Section 504 with an Individualized Education Program (IEP). While both support students with disabilities, they are governed by different laws.

• An IEP is for students who need specialized instruction and significant modifications to the general curriculum. It falls under the Individuals with Disabilities Education Act (IDEA).

• A 504 Plan is for students who can learn in a general education classroom but need accommodations to access learning equally (e.g., extended time on tests, preferential seating, large-print materials).
